What is Personal Injury?

Personal injury is widely defined although to recover compensation there must be recognisable damage which has given rise to pain and suffering. It is also possible to pursue claims for psychological symptoms even if these are not associated with any physical injury, although strict rules define the circumstances in which such a claim may succeed.
To pursue a successful personal injury compensation claim it is usually necessary to establish that somebody else was at fault. The negligent act giving rise to personal injury must normally have occurred in England and Wales, although it is possible to apply UK law to some accidents abroad. This will depend on the circumstances in which the accident occurred and the identity of the negligent party. Both Scotland and Northern Ireland have separate jurisdictions for this purpose.
The level of compensation that can be recovered will depend upon the nature of the injury and the losses and expenses that arise as a consequence. This is not always easy to determine and disputes often arise. Pre-existing medical conditions may also have an impact on the claim whilst there may be more than one potential cause for a particular condition. Expert medical evidence will often be required to address these issues.
Time limits apply to all claims for personal injury compensation. In England and Wales, court proceedings must be issued within 3 years from the date of the accident or the development of the injury. A number of exceptions do apply in certain circumstances and in a limited number of cases it may be possible to persuade the court to set aside the 3 year time limit.
